These Terms & Conditions are governed exclusively by Austrian law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
For consumers residing in the European Union, this choice of law applies only insofar as it does not deprive you of the mandatory protections afforded by the laws of the country in which you reside.

SPECIAL NOTICE ON SECONDHAND / VINTAGE GOODS
All products offered by THE PURIST STUDIO are secondhand and/or vintage items, not new.
Each piece is carefully inspected, authenticated, and offered in the described condition.
Secondhand items may show signs of age or previous use (e.g., minor scratches, discolorations, light material wear). These are not defects but unique characteristics that contribute to the individuality of each item.
The condition of each item is determined by the descriptions and details provided on the product page. Images may vary slightly from the actual item due to screen settings.
Statutory warranty rights remain unaffected but apply only to defects already present at the time of delivery, not to normal wear and tear typical for secondhand items.
SECTION 3 – ORDERS
By placing an order, you submit a binding offer to purchase. THE PURIST STUDIO reserves the right to accept or reject any order at its sole discretion. Your order is considered accepted only once confirmed by us. Acceptance requires receipt and processing of payment. Please review your order carefully before submitting, as cancellation requests may not be accommodated after acceptance. If we decline, amend, or cancel an order, we will attempt to notify you via the contact details provided at checkout.
Returns and exchanges are handled exclusively in accordance with our Return Policy [LINK].
You represent and warrant that your purchases are intended for personal or household use only and not for commercial resale or export.
SECTION 4 – PRICES & BILLING
Prices, discounts, and special offers are subject to change without notice. The price charged for a product or service is the price in effect at the time of your order and will be confirmed in your order email. Unless otherwise stated, listed prices do not include taxes, shipping, handling, customs, or import duties.
All prices are final under the Austrian Small Business Regulation (§ 6 Abs. 1 Z 27 UStG) and therefore exempt from VAT. No VAT is shown on invoices.
Prices may vary between our online shop, physical locations, or third-party platforms. From time to time, promotional offers may apply that are subject to specific terms, which take precedence over these Terms in the event of conflict.
You agree to provide accurate, current, and complete purchase, payment, and account information for all transactions and to promptly update this information when necessary.
You represent and warrant that (i) your payment information is truthful and complete, (ii) you are authorized to use the chosen payment method, and (iii) you will pay all charges at the listed prices, including applicable shipping and fees.
SECTION 5 – SHIPPING & DELIVERY
We are not liable for shipping or delivery delays. All delivery times are estimates only and not guaranteed. We are not responsible for delays caused by carriers, customs, or events beyond our control. Risk of accidental loss passes to you only upon delivery of the goods.

All content on this website (texts, images, graphics, designs, logos, trademarks, and other works) is protected by copyright and/or trademark law. Any use, reproduction, distribution, or public display without our express consent is prohibited. All rights remain reserved by THE PURIST STUDIO.

SECTION 9 – RELATIONSHIP TO SHOPIFY
Our Services are hosted by Shopify, but all sales are made directly with THE PURIST STUDIO. Shopify is not a contractual party to these transactions and bears no liability for any claims, losses, or damages arising from your purchases. By using the Services, you release Shopify from such liability.

SECTION 15 – WARRANTY DISCLAIMER
Statutory warranty rights apply. The warranty period is two years from delivery. Any voluntary manufacturer warranties remain unaffected.
SECTION 16 – LIMITATION OF LIABILITY
We are fully liable for intent and gross negligence. For slight negligence, we are liable only for damages resulting from injury to life, body, or health, and for breaches of essential contractual obligations. In such cases, liability is limited to foreseeable, typical damages. Liability under the Austrian Product Liability Act remains unaffected.
SECTION 17 – INDEMNIFICATION
You agree to indemnify and hold harmless THE PURIST STUDIO, Shopify, and affiliates against claims or damages resulting from your violation of these Terms, applicable law, or third-party rights.
SECTION 18 – SEVERABILITY
If any provision of these Terms is found to be unlawful or unenforceable, the remaining provisions remain valid and enforceable.
SECTION 19 – WAIVER AND ENTIRE AGREEMENT
Failure to enforce a provision does not constitute a waiver. These Terms constitute the entire agreement between you and THE PURIST STUDIO and supersede prior agreements.
SECTION 20 – ASSIGNMENT
You may not assign or transfer your rights under these Terms without our prior written consent. We may assign or transfer our rights without restriction.
SECTION 21 – GOVERNING LAW
These Terms are governed by Austrian law. The place of jurisdiction is Vienna, unless mandatory consumer protection law dictates otherwise.

Headings are for convenience only and do not affect interpretation.
SECTION 23 – AMENDMENTS TO TERMS
The current version of these Terms can always be reviewed on this page. We reserve the right to amend these Terms at any time by posting updates on our website. Substantial changes will be communicated as required by law. Continued use of the Services after changes constitutes acceptance of the updated Terms.
